Somalia. Ipotesi per una ricostruzione fondata sulla legalità economica tra criticità geopolitiche e fattori criminali interni

Abstract
This essay aims to present concrete organizational and structural hypotheses for reaffirming legality, especially in the economic sphere, a fundamental pillar for the proper functioning of a constitutional state. It is first emphasized that for the effective and complete implementation of the proposed proj¬ect, it is essential and urgent to proceed with the pervasive and widespread dissemination of the culture of economic legality. This is a prerequisite for achieving the ambitious objectives outlined above, particularly to curb the harmful phenomenon of corruption, which is unfor¬tunately deeply rooted in Somalia. To concretely implement economic legality, a series of specific and targeted state interventions are proposed, aimed at establishing specific bodies and entities operating both in the justice sector, especially the judiciary, and in the economic-financial sector. Specifically, to achieve the above, it is essential to establish cooperation or collaboration agreements with EU states, preferably those most active in the fight against mafias, primarily Italy, in order to acquire the necessary technical and legal expertise to conduct targeted financial investigations to prevent and combat economic crime — here defined as corruption, money laundering, and terrorist financing — which is currently undermining the foundations of the Somali state. In conclusion, through “intelligence inferences,” an abductive epistemological procedure (Sidoti 2002), it is found that the implementation of the organizational prospects described above would be highly subject to external political and economic influences, exerted by a foreign Asian power, which could constitute, among other things, criminogenic factors for Somalia.
Il saggio intende esporre delle ipotesi organizzative e strutturali concrete per riaffermare la Legalità, soprattutto in campo economico, asse fondamentale per il corretto funzionamento di uno Stato di diritto. Preliminarmente viene posto in risalto che per un’efficace e completa realizzazione della progettualità proposta, si rende necessario e improcrastinabile procedere a una pervasiva e capillare diffusione della cultura della Legalità Economica, quale conditio sine qua non per il raggiungimento degli ambiziosi obiettivi di cui sopra, in particolare per arginare il nefasto fenomeno della corruzione, purtroppo gravemente radicato in Somalia. Per applicare, nel concreto, la Legalità Economica viene proposta una serie di precisi e mirati interventi statali, diretti a istituire specifici organismi e enti operanti sia nel settore della giustizia, soprattutto nella magistratura, che in quello economico-finanziario. Nello specifico, per la realizzazione di quanto così indicato risulta comunque indispensabile predi¬sporre accordi di cooperazione o collaborazione con Stati della U.E., possibilmente con quelli maggiormente attivi nella lotta alle mafie, in primis l’Italia, al fine di acquisire le necessarie competenze tecnico-giuridiche per porre in essere mirate indagini finanziarie per prevenire e contrastare il crimine economico, qui inteso come Corruzione, Riciclaggio e Finanziamento al terrorismo, che attualmente concorre a minare fortemente le fondamenta dello stato somalo. In conclusione, mediante “inferenze d’intelligence”, un procedimento epistemologico di tipo abduttivo (Sidoti 2002), viene rilevato che la realizzazione delle prospettive organizzative, così descritte, sarebbe fortemente soggetta a condizionamenti politici ed economici esterni, posti in essere da una potenza straniera asiatica, che possono costituire, tra l’altro, fattori criminogeni per la Somalia.
