Abstract
Il rapporto tra diritto e guerra può essere considerato sia come opposizione tra due concetti radicalmente antitetici, assolutamente incompatibili, per cui dove c’è guerra non c’è, o non c’è più, diritto e dove c’è diritto non ci può essere guerra, sia come complementarietà, rapporto dialettico, per cui, così come il diritto può non essere totalmente giusto o totalmente ingiusto, allo stesso modo potremmo dire che in genere si verificano conflitti che non sono né totalmente giusti né totalmente ingiusti, né per quanto riguarda una parte, né per quanto riguarda l’altra. In questa seconda prospettiva è possibile pensare anche ad un ordinamento del conflitto che ne consenta il superamento non nei ter- mini dell’annientamento del nemico, ma in quelli di una riconciliazione, della ricostruzione di un rapporto tra parti che si riconoscono reciprocamente per la comune umanità.
The relationship between law and war can be con- sidered both as the opposition between two radi- cally antithetical concepts, absolutely incompa- tible, for which where there is war there is no, or no longer exists, law and where there is law there cannot be war, both as a complementarity, a dialectical relationship, whereby, just as the law may not be totally just or totally unjust, in the same way we could say that generally conflicts occur that are nei- ther totally just nor totally unjust, nor as far as it concerns one party, nor of the other. In this second perspective, it is also possible to think of an orde- ring of the conflict that allows it to be overcome not in terms of the annihilation of the enemy, but in terms of reconciliation, of the reconstruction of a relationship between parties who mutually reco- gnize each other for the common humanity.
