Abstract
This essay reconstructs some of the theses put forward by José Juan Moreso in his 2020 book, Lo Normativo. In particular, the author dwells on the incorporationist approach to judicial rea-soning, arguing, through a series of jurisprudential examples, that the relationship between law and morality in judicial practice cannot be limited to those cases in which one is faced with what Moreso calls “defeaters”.
