Conceptualising the Irish Immigration System for Third-Country Migrants

Abstract
Historically, Ireland was a country of mass emigration, rather than net immigration. However, the continuous influx of refugees during the mid 1990s imposed a revision to its immigration system. In this respect, the chapter provides an analysis of the Irish legal system in relation to third-country migration, and demonstrates two key characteristics of the employment permit system: ministerial discretion and the propensity to operate on almost purely administrative basis.
Storicamente, l'Irlanda era un Paese di emigrazione di massa, anziché di immigrazione. Tuttavia, l'afflusso continuo di rifugiati
durante la metà degli anni '90 ha imposto una revisione al suo sistema di immigrazione. In questo contesto, il capitolo fornisce un'analisi del sistema giuridico irlandese in relazione alla migrazione di paesi terzi e dimostra due caratteristiche fondamentali del sistema del permesso di lavoro: la discrezione ministeriale e la propensione ad operare su base quasi puramente amministrativa.
