Abstract
This essay addresses a leading question concerning legal principles: in order to respect a claim for normative consonance with praxis and human experience, should these principles be treated as topical-dialectical regulae iuris? Conceived of as a dialogue with Silvia Niccolai’s powerful research, it explores, in counterpoint, the major contributions that, concerning the reinvention of Law as an autonomous practical world, we owe to Alessandro Giuliani and António Castanheira Neves.
