Prospettive di filosofia della pena in margine alla traduzione commentata del libro I del De ira di Seneca a cura di A. Musio. Un’analisi filosofico giuridica

Abstract
The essay focuses on Andrea Musio’s recent translation and commentary on Book I of Seneca’s De ira; from this perspective, it takes on a variety of purposes: first of all, it aims to highlight the innovative aspects of this interpreta¬tion, characterised by a distinctive philosophical nature; secondly, it seeks to emphasise the legal-philosophical elements that permeate Seneca’s text as a whole with vivid originality; thirdly, it proposes to outline a coherent interpretative perspective of Seneca’s philosophy of pun¬ishment, as it emerges in the text examined. In this sense, thanks also to Musio’s observations on the nature of punishment and its differences from the instinct for revenge, it is possible to recognise in the philosopher from Cor¬doba a vision similar to classical penology, in particular Aristotelian penology, based on the idea of punishment as an expression of the virtue of justice and therefore capable of harmoniously combining in its nature a fundamental retributive meaning and a re-educational-correctional instance.
Il saggio ha come oggetto la recente traduzione commentata del Libro I del De ira di Seneca realizzata da Andrea Mu¬sio; esso assume, in tale prospettiva, una pluralità di scopi: anzitutto, si prefigge di enucleare gli aspetti innovativi di tale lettura, connotata da una peculiare filosoficità; in secon¬do luogo, ambisce ad evidenziare gli elementi giusfilosofici che innervano complessivamente e con viva originalità il te¬sto senecano; in terzo luogo, si propone di tratteggiare una coerente prospettiva interpretativa della filosofia della pena senecana, per come emerge nel testo esaminato. In tal senso, grazie anche ai rilievi di Musio in merito alla natura della sanzione e alle sue differenze rispetto all’istinto vendicati¬vo, è possibile riconoscere nel Cordovese una visione affine alla penologia classica, in particolare aristotelica, poggian¬te sull’idea di una pena come espressione della virtù della giustizia e perciò capace di coniugare armonicamente nella propria natura un fondante significato retributivo ed un’i¬stanza rieducativo-correzionale.
