Abstract
The contribution presents a critical examination of the el¬ements of the philosophy of law that emerge from reading a famous work by Henrik Stangerup. The analysis takes into consideration the dystopian perspective offered by the work and seeks to verify the contemporary relevance of certain legal paradigms: ‘guilt’, ‘sanction’ and ‘autono¬my’. In this way, the contribution seeks to offer a critical view of the authority inside the contemporary legal sys¬tems as it constrains the freedom of the individual in ways that deny the dignity of the person and his relations with other subjects.
Il contributo presenta un esame critico degli elementi di filo¬sofia del diritto che emergono dalla lettura dell’opera mag¬giormente nota di Henrik Stangerup. La disamina prende in considerazione la prospettiva distopica offerta dall’opera e cerca di verificare la rilevanza contemporanea di alcuni paradigmi giuridici: ‘colpa’, ‘sanzione’ e ‘autonomia’. Sulla base di questi elementi fondativi, il contributo cerca di offri¬re una visione critica sul ruolo dell’autorità all’interno dei sistemi giuridici contemporanei, nel momento in cui coarta la libertà del soggetto con modalità che negando la dignità dello stesso nel vincolare le sue relazioni con gli altri soggetti, ne etero-determina l’identità.
