Discriminazione di genere e misure a sostegno della cura/conciliazione nel settore privato

Abstract
The essay, after having provided in the first part a synthetic quantitative and qualitative picture of the situation of female employment in Italy and having analyzed some recent interventions of the legislator, evaluates the role played by the social partners in increasing the work-life balance measures offered by legislation to private sector workers. The most interesting provisions contained in both company and national collective bargaining are examined, in terms of organizational flexibility for the worker, of personal leaves or permits, of economic support. The company collective agreements prove to be very incisive in experimenting with work-life balance ideas, but they are applied to few workers. The function of the national collective bargaining agreement (CCNL) in this area is therefore residual but its greater role is desirable to increase the number of workers affected by these measures. A possible solution could be the strengthening of the work-life balance provisions offered by CCNL established bilateral agencies.
Il contributo, dopo aver fornito nella prima parte un sintetico quadro quantitativo e qualitativo della situazione dell’occupazione femminile in Italia ed aver analizzato alcuni recenti interventi del legislatore, valuta il ruolo ricoperto dalle parti sociali nell’accrescere le misure di conciliazione vita-lavoro offerte dalla legislazione ai lavoratori dell’impiego privato. Sono esaminate le previsioni maggiormente interessanti contenute nella contrattazione collettiva sia aziendale che nazionale, sotto il profilo della flessibilità organizzativa per il lavoratore, della fruizione di congedi o permessi, delle misure di sostegno economico. Il contratto collettivo aziendale si rivela molto incisivo nello sperimentare formule di work life balance, ma trova applicazione a pochi lavoratori. La funzione del CCNL in quest’ambito è quindi residuale ma è auspicabile un suo maggior ruolo, per accrescere il numero dei lavoratori interessati da tali misure. Una possibile soluzione potrebbe essere il rafforzamento degli strumenti conciliativi a carico della bilateralità istituita dai CCNL.
