La violenza cibernetica contro le donne in area MENA

Abstract
The forms that violence against women can take are diverse, from early marriage to the reparative marriage that extinguishes the crime of rape; from sexual harassment at work and in public places that suppresses women's freedom of movement and emancipation to violence suffered at the hands of family members(in-laws, parents, siblings); from the impossibility of access to education to domestic confinement. A particular type of violence is that carried out through new communication technology tools, in particular e-mail services, social media and content-sharing apps. The phenomenon of cybernetic violence, which is also rampant in MENA countries, has not yet been the subject of a clear and comprehensive regulation; in Arab countries, which only a few years ago began to address the issue of violence against women on a legislative level, cybernetic violence still finds few responses from the legislator and little attention from the jurisprudence.
Le forme che la violenza contro le donne puo assumere sono diverse, dal matrimonio precoce al matrimonio riparatore che estingue il reato di stupro; dalle molestie sessuali sul lavoro e nei luoghi pubblici che comprimono la liberta di movimento e l’emancipazione femminile alla violenza subita a opera di membri della famiglia (marito, suoceri, genitori, fratelli); dall’impossibilita di accedere all’istruzione al confinamento domestico. Una tipologia particolare di violenza e quella attuata attraverso i nuovi strumenti tecnologici per le comunicazioni, in particolare i servizi di posta elettronica, i social media e le app di condivisione di contenuti. Il fenomeno della violenza cibernetica, dilagante anche nei paesi dell’area MENA, non e ancora stato oggetto di una disciplina chiara e completa; nei paesi arabi, che solo da pochi anni hanno iniziato ad affrontare sul piano legislativo la questione della violenza contro le donne, la violenza cibernetica trova ancora poche risposte dal legislatore e scarsa attenzione dalla giurisprudenza.
