Disaccordo e diritto immorale
Biasetti, Pierfrancesco

Abstract
In his volume Conflitti Pratici, Damiano Canale argues that when the law demands a certain behavior or denies a certain opportunity, and this appears unacceptable to its recipients because it contradicts their fundamental reasons to act (that is, their moral reasons to act), then, the law became immoral. Canale characterizes this kind of situation as a practical conflict: on the contrary, in this contribute I will present an analysis of the clash between juridical and moral norms in terms of a peculiar kind of moral disagreement. In this way, I hope to show that it is misleading to speak of “immoral law” in the sense adopted by Canale, because the clash is actually between two different perspectives on morals.
