    Novità legislative per armatori e raccomandatari marittimi

    Dopo il via libera della Commissione Europea all’introduzione in Italia della Tonnage tax, il regime d’imposta forfetaria alternativo all’ordinaria imposizione sui redditi, che in base al tonnellaggio individua differenziate fasce d’imposta per le imprese di trasporti marittimi, la questione, per fini applicativi, dovrà tornare all’Esecutivo. Difatti, per poter rispettare il termine di applicazione della nuova tassa , fissato dal Governo nel 2004, il Ministero delle finanze dovrà approntare ed approvare il regolamento attuativo del Decreto Legislativo in questione. Va osservato che gli effetti del Decreto si tradurranno pr3esto non solo in un vantaggio fiscale, ma soprattutto conferiranno una maggiore competitività al sistema armatoriale italiano, inducendo gli armatori ad operare e strumentare le loro sfide imprenditoriali dall’Italia, con l’incremento anche del carico iscrizionale presso il registro Internazionale Italiano. La “scepsi” del Decreto Legislativo n. 344/2003 ci consente di fermare alcune significative osservazioni in ordine all’impatto ed alle incidenze che lo stesso è destinato a produrre nella compagine dello shipping sia nazionale che internazionale.

    In tema di regime comunitario della concorrenza nei servizi portuali

    In tema di concorrenza fra servizi portuali, più precisamente fra le imprese che effettuano nei porti marittimi operazioni portuali, risulta, allo stato attuale, largamente acquisita, la preminenza del diritto comunitario rispetto a quello degli stati membri, che sembra sopravvivere limitatamente a quegli scali marittimi considerati di rango inferiore, secondo un riferimento specifico, alla categoria dei porti definiti di “importanza internazionale” dalla decisione n. 1692/96 C.E. E’ importante notare che il diritto ad operare in proprio non ha alcuna influenza sulle normative nazionali in merito a requisiti di formazione, qualifiche professionali, occupazione e materie sociali ivi incluse accordi collettivi, alla condizione che questi siano compatibili con la legislazione comunitaria e gli obblighi internazionali della Comunità e dello Stato membro di cui trattasi.

    L’evoluzione normative dei lavori pubblici dopo la “legge obiettivo”

    Con l’obbiettivo di “realizzare opera pubbliche di qualità e nel minor tempo possibile”, il legislatore si è posto il problema di come accelerare gli iter normativi delle opere pubbliche modificando, se il caso, il preesistente impianto normativo e legislativo prevedendo – nel settore delle cosiddette “grandi opere strategiche di preminente interesse nazionale” – l’istituzione di nuove figure come il General Contractor, con il fine di assicurare l’esecuzione e la consegna dell’opera “chiavi in mano” nei tempi stabiliti.

    Downgrading the European asymmetries

    In the border zone, up to the year 1420 the Aquileia patriarcate had dominate the old Celtic Friuli, typically mountainous with an agriculturally oriented economy, with a local peculiar language the Friulano, an oriental version of a ladin language. The near by Gorizia Countee, before the Habsburg rule, after the Count of Gorizia and Tirol Henry the 2nd who was ruling in 1500 his broad possession as lord of Treviso from the Bruck Castle near Lienz and Conegliano, had always been a Region characterized by the Venetian accents, comprehensible till down to the Bocche di Cattaro in Dalmatia, where till now sounds the typical Serenissima accents, which is common in the Goritian Countee firstly and in the Triestine dialect later. In the year 2004, Trieste, Gorizia, Monfalcone, Sezana and Koper are again commonly involved on an historical recurrence within the area of the old Countee at the moment of the inclusion within the European Union of the whole Nord East region at the end of the Northern Adriatic sea which during the last 1800 years, has seen the struggle of the Western with the Eastern Empire, that of the Mediterranean Latin culture against the invading Celtics, that of the Illiric Republic against the Cisalpine an finally that of the force of the Warsaw Pact against the Nato Alliance, always the Indo-European languages against each other within the Microcosm in an Euro Region. The logistic platform represented by the hihway cross the border stations of Fernetti, Rabuiese, S. Andrea in Gorizia and Vertojba in Sempeter-Vertojba, may become a huge hub in the future Euroregion, including Slovenia at the Adriatic crossing, raising the relevant perspective of an adjustment of the European asymmetries, possible trought the action of the fifth corridor Lisbon Kiev and the integrated structures of the Trieste-Koper harbours connected to Cervignano and Ronchi airport. The present Italian fiscal code adjustment seem to proceed in this direction allowing a more flexible tax planning and financial consolidation trough more easily applicable international accounting standards and taxing planning trough rules and agreements with the taxing authorities. The mix of local population, generally speaking several foreign languages, with ancient ties with both the East and the West represent a valuable unique asset in promoting such a new vision.
